As per the Number 73 of Chapter of Marriage of Civil Code marriage should be compulsory registered either before court or before the concerned authority ( i.e. ward office or at Embassy of Nepal/ Consulate Office). The authority should provide the marriage registration certificate within 15 days of submission of the application.
Eligibility for Marriage Registration in Nepal
Section 70 of the Muluki Civil Code lists the following criteria for a man and a woman to be able to get married.
Both men and women accept each other as wife and husband.
If the couple are not related by blood such that they can’t be punished for incest.
If man and woman are not already married.
If both are 20 years of age.
Documents Required for Marriage
Application: Duly filled and signed application form in the prescribed format.
Photo: Passport size photo of couple (10 pcs)
Self-Declaration: Consensus paper in the prescribed format.
Residential Proof: Recommendation letter from local ward office for temporary residence. This is required for both the applicants.
Unmarried Status Certificate: Unmarried or single status recommendation letter issued from the local ward. This is required for both the applicants.
Photo ID: Original citizenship of Applicants.
Witnesses: Original citizenship of Witnesses.
Court Marriage for Foreign Citizens in Nepal
No-Objection Letter: No objection letter from respective embassy or consulate to get married in Nepal. This must be translated into Nepali language and notarized by the Notary public.
Character Verification: Letter of the residing country that the foreigner doesn’t have any criminal record.
Others: An excerpt of the law of respective countries governing marriage. This must be translated in Nepali and notarized by the Notary public.
Photo ID: Passport and valid visa issued by the Department of Immigration in Nepal. This must be notarized by the Notary public.
Marriage Registration through Embassy or Consulate Office
Pursuant to Number 76 and 77 of the Chapter of Marriage of Civil Code people residing at foreign can register the court marriage before the Embassy of Nepal or Consulate Office located at foreign country. Though the law has provided the marriage registration from the Embassy or Consulate Office however in practice there are no such instance of registration through the Embassy or Consulate Office.
